Participant Policies and Terms & Conditions Agreement


 

1. Liability:

  1. Participants attend the workshop at their own risk and will be responsible for any damage or injury caused to themselves or others.

  2. The organizers and instructors will take reasonable precautions to ensure safety during the workshop but cannot be held liable for accidents, loss, or damage.

2. Physical Capability:

  1. Participants must be physically capable of engaging in activities that may require standing for extended periods, walking for durations of up to 30-60 minutes, and potentially exceeding 3 hours total.

  2. Participants should assess their own physical fitness and consult with a medical professional if they have any concerns or pre-existing conditions that may hinder their ability to participate in these activities.

  3. The organizers and instructors cannot be held responsible for any health issues, injuries, or discomfort resulting from a participant's inability to meet the physical requirements of the workshop.

 

3. Severability:

  1. If any provision of these policies is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

 

4. Limitation of Liability:

  1. The total liability of the organizers and instructors for any claims arising from the workshop, including negligence, shall not exceed the total amount paid by the participant to attend the workshop.

 

5. Indemnification:

  1. Participants agree to indemnify and hold harmless the organizers and instructors from any claims, damages, or expenses arising out of their participation in the workshop.

  2. Participants specifically acknowledge their responsibility to refrain from making false, defamatory, or disparaging statements about the workshop, its organizers, or instructors, both during and after the workshop.

  3. In the event that a participant makes false, defamatory, or disparaging statements about the workshop, its organizers, or instructors, the participant shall be held responsible for any damages caused, including financial losses, harm to reputation, or legal consequences.

  4. The participant agrees to reimburse the organizers and instructors for any costs or damages incurred as a result of their false, defamatory, or disparaging statements.

 

6. Health, Travel, and Cancellation Insurance:

  1. Participants are solely responsible for arranging and maintaining their own health, travel, and cancellation insurance coverage for the duration of the workshop.

  2. The organizers and instructors shall not be held responsible for any medical expenses, injuries, illnesses, or accidents that may occur during the workshop or any related travel.

  3. Participants are advised to obtain comprehensive insurance coverage to protect against any unforeseen circumstances, including but not limited to medical emergencies, trip cancellations, or loss of personal belongings.

 

7. Dispute Resolution:

  1. Any disputes arising from the workshop shall be resolved through negotiation and, if required, through mediation or arbitration in accordance with the laws of Italy and/or the United States of America. 

 

8. Photography and Filming:

  1. Participants agree to be photographed, filmed, or otherwise recorded during the workshop.

  2. Participants grant the organizers and instructors the right to use, reproduce, publish, or distribute the resulting photographs, videos, or recordings for promotional, educational, or other related purposes without compensation or notification.

  3. Participants waive any rights, claims, or interests they may have in connection with the use of their image or likeness captured during the workshop.

 

9. Disclaimer: 

  1. The organizers and instructors make no warranties or guarantees regarding the outcome, quality, or success of participants' work created during the workshop.

 

10. Assignment:

  1. Participants may not assign their rights or obligations under these policies without the prior written consent of the organizers.

 

11. Transportation of Materials:

  1. Participants are responsible for transporting their own materials, supplies, and equipment to the workshop location.

  2. The organizers and instructors shall not be held liable for any loss, damage, or theft of participants' materials during transportation to or from the workshop location.

  3. Participants are advised to ensure that their materials are appropriately packaged, labeled, and secured for safe transportation.

 

12. Right to Refuse Participation:

  1. The organizers and instructors reserve the right to refuse participation or remove any participant from the workshop if their behavior is deemed disruptive, disrespectful, or poses a risk to themselves or others. In such cases, no refund will be provided.

 

13. Changes or Cancellations:

  1. The organizers reserve the right to make changes to the workshop schedule, venue, or instructors if necessary. Participants will be notified of any significant changes as soon as possible. 

  2. In the event of a workshop cancellation by the organizers due to unforeseen circumstances, participants will be entitled to a refund of the workshop fee. The organizers shall not be held liable for any additional expenses or damages incurred by participants.

 

14. Personal Property:

  1. Participants are responsible for the safety and security of their personal belongings during the workshop. The organizers and instructors shall not be held liable for any loss, theft, or damage to participants' personal property.

 

15. Health and Medical Conditions:

  1. Participants are responsible for informing the organizers and instructors in advance of any relevant health or medical conditions that may impact their participation in the workshop. This information will be treated confidentially and used to ensure the safety and well-being of the participant.

 

16. Force Majeure:

  1. The organizers and instructors shall not be held liable or responsible for any failure or delay in the performance of their obligations under these policies if such failure or delay is due to circumstances beyond their reasonable control, including but not limited to natural disasters, acts of God, government actions, or other unforeseen events.

 

17. Intellectual Property:

  1. Participants retain ownership of the work they create during the workshop.

  2. Participants grant the organizers and instructors a non-exclusive, royalty-free license to use photographs or images of their works for promotional or educational purposes related to the workshop.

18. Bedroom Assignment:

  1. The assignment of bedrooms or accommodations within the workshop venue is at the discretion of the organizers. While efforts will be made to accommodate participant preferences, the organizers reserve the right to make final decisions regarding the assignment of bedrooms based on availability and logistical considerations.​

 

19. Code of Conduct:

  1. Participants are expected to conduct themselves in a respectful and professional manner throughout the workshop, treating fellow participants, organizers, and instructors with courtesy and consideration.

  2. Any form of harassment, discrimination, or disruptive behavior will not be tolerated and may result in immediate removal from the workshop without refund.

 

20. Privacy and Data Protection:

  1. The organizers will collect and process personal data provided by participants solely for the purpose of organizing and facilitating the workshop. This data will be handled in accordance with applicable privacy laws and regulations.

  2. Participants have the right to request access, correction, or deletion of their personal data by contacting the organizers.

 

21. Photography and Recording Restrictions:

  1. Participants are prohibited from photographing or recording any instructional materials, demonstrations, or presentations during the workshop without prior permission from the organizers and instructors.

 

22. Non-Transferability:

  1. Participation in the workshop is non-transferable. Participants may not transfer their registration or workshop materials to another individual without the prior written consent of the organizers.

 

23. Prohibited Uses:

  1. Participants are not allowed to use any known hazardous or toxic materials during the workshop. 

  2. Participants must respect the property and premises where the workshop takes place, and may be responsible for the cost of damages incurred. 

  3. Any disruptive, disrespectful, or inappropriate behavior will not be tolerated and may result in removal from the workshop without refund.

24. Food Accommodations:

  1. The organizers will make reasonable efforts to accommodate participants with known food allergies or intolerances. Participants must notify the organizers in advance of any dietary restrictions or specific requirements, but accommodations are not in any way guaranteed. 

  2. While efforts will be made to provide suitable meal options, the organizers cannot guarantee the absence of allergens or cross-contamination. Participants with severe allergies or sensitivities are encouraged to take necessary precautions and assume personal responsibility for their dietary choices during the workshop.

  3. Participants are advised to consult with the venue staff or event organizers regarding ingredient information and exercise their own judgment in determining the suitability of the provided food.

  4. Participants with severe allergies or major accommodation requirements may be obligated to purchase food from the grocery store and prepare it at their own expense. 

25. Room Conditions:

  1. The organizers strive to provide comfortable and clean accommodations for participants. However, participants understand and acknowledge that variations in room conditions may exist, and the organizers shall not be held responsible for any perceived discrepancies.

  2. Participants are encouraged to report any issues or concerns regarding their room conditions to the organizers promptly for resolution.

26. Accommodation Changes:

  1. In rare circumstances, it may become necessary to make changes to the originally planned accommodations due to unforeseen circumstances. The organizers will make reasonable efforts to provide alternative accommodations of equal or higher quality.

  2. Participants will be notified of any significant changes to their accommodations as soon as possible.

27. Outside Food and Drinks:

  1. Participants acknowledge and agree that any food and drinks purchased or consumed outside of what is included in the workshop/castle accommodations are their sole responsibility.

  2. The organizers will provide meals and beverages as specified in the workshop itinerary or package, (light breakfast and lunch, and dinner) and any additional food or drink expenses incurred by participants outside of these provided meals will be the participants' own financial responsibility.

  3. Participants are advised to budget accordingly and make appropriate arrangements for their personal food and beverage needs beyond what is offered by the organizers.

28. Food and Drinks Purchased During Tours: 

  1. Participants acknowledge and understand that certain workshop activities may include tours to Florence, during which participants may have the opportunity to purchase food and drinks from local establishments.

  2. Participants agree that any food and drinks purchased during these tours are their sole responsibility, and the organizers shall not be held liable for any expenses, issues, or experiences related to such purchases.

  3. It is the responsibility of participants to make informed choices regarding food and drink consumption, including consideration of dietary restrictions, allergies, and personal preferences.

  4. The organizers may provide recommendations or suggestions for dining options in Florence, but participants acknowledge that the final decision to purchase and consume food and drinks during the tours is their own. 

29. Additional Food and Drinks Provided by the Organization:

  1. Participants understand and acknowledge that any additional food or drinks provided by the organization beyond what is explicitly included in the workshop package or itinerary are at the sole discretion of the organizers.

  2. The organizers may choose to offer complimentary or additional food and drinks during specific workshop activities or events as a gesture of goodwill or to enhance the participants' experience.

  3. Participants agree that the provision of such additional food or drinks by the organization does not create an expectation or entitlement for future workshops or events, and the organizers reserve the right to modify or discontinue such offerings without prior notice.

  4. Any additional food or drinks provided by the organization shall be subject to availability and may be limited in quantity or variety.

 

30. Acknowledgments:

  1. Participants acknowledge that they have read, understood, and agreed to abide by these policies and any additional instructions provided by the organizers and instructors.

  2. Participants acknowledge that the organizers and instructors have made no guarantees or promises regarding individual skill development or improvement as a result of attending the workshop.

  3. Participants acknowledge that any work created during the workshop is subject to their own interpretation and that the organizers and instructors are not responsible for the outcome or merit of the participants' work.

 

Effective Date: Effective immediately

Entire Agreement:

  1. These policies and terms constitute the entire agreement between the participants and the organizers, superseding any prior discussions, representations, or agreements, whether written or oral.

Governing Law and Jurisdiction:

  1. This agreement shall be governed by and construed in accordance with the laws of the USA. Any disputes arising from or related to this agreement shall be subject to the exclusive jurisdiction of the courts located in the USA.

Amendments:

  1. The organizers reserve the right to modify or update these policies and terms as needed. Participants will be notified of any amendments, and their continued participation in the workshop will indicate their acceptance of the revised policies.
